Ownership

The photographs and works of Álvaro Ybarra Zavala are protected by intellectual property law. Álvaro Ybarra Zavala is their author and the holder of their rights.

This policy applies to his photographs as presented on this website, in the Store and in the Archive. Visiting or consulting them does not grant any licence.

Prior written authorisation

Any reproduction, distribution, public communication or transformation that requires authorisation needs the prior, express and written authorisation of the author. This covers printed and digital formats, media outlets, websites, social networks, platforms, audiovisual productions, exhibitions, campaigns and products.

Giving credit, linking to the source, or a non-commercial or educational purpose does not in itself amount to authorisation.

Licences and scope

Licences are granted case by case, with a quote. Each licence defines the authorised photographs, the licensee, the purpose, the medium or format, the publications or accounts and platforms, the territory, the duration, the print run or number of insertions where applicable, and the financial terms.

No reuse, new edition, extension, new platform or format, assignment or sublicence to third parties outside the authorised scope is permitted without a new written authorisation. The delivery of a file, a quote, the absence of a reply or a previous authorisation do not amount to a new licence.

Integrity of the work

Without specific written authorisation, photographs may not be cropped, reframed, retouched, processed, filtered, changed in colour or contrast, converted to black and white, distorted, used in montages, have elements added or removed, have text overlaid, or be altered with artificial intelligence. The composition, proportions and appearance conceived by the author must be respected.

Technical adjustments are only allowed within the agreed terms and without altering the appearance of the image. If they would affect it, approval must be requested.

Credit and rights information

Credits, notices, identifiers and rights metadata must be preserved. The required credit, as set out in each licence, is “© Álvaro Ybarra Zavala”.

The signature may not be removed, and the work may not be presented in a context that distorts its meaning.

Artificial intelligence

Use of these photographs without authorisation to train machine learning or generative artificial intelligence models is expressly prohibited.

Purchase of physical works

Buying a physical work or a book does not transfer any intellectual property rights and does not grant a reproduction licence.

Applicable law

Licence terms are governed by Spanish law, in particular the consolidated text of the Intellectual Property Law approved by Royal Legislative Decree 1/1996, without prejudice to any applicable mandatory rules.

Authorship and sales

Álvaro Ybarra Zavala retains the intellectual property rights in his photographs. The Store at alvaroybarra.com is currently the only direct sales channel authorised by the author for his photographic works and new books. Sales are made and invoiced through Ovisara XXI, S.L.

This commercial exclusivity refers to the direct offer authorised by the author and does not restrict any subsequent transfer of legitimately acquired copies permitted by applicable law.

What a purchase includes

A purchase transfers ownership of the physical copy acquired, with the characteristics and edition scope stated in its description. It does not transfer the copyright in the photograph, nor does it in itself grant a licence to reproduce, publish, transform or commercially exploit it. Any rights that applicable law grants to the owner of the copy remain unaffected.

Editions, descriptions and coexisting collections

The exclusivity and limits of each edition are defined by the characteristics of the work and of its collection. The same image may be part of different collections with different characteristics, without extending the limits of the edition acquired. The description of each work must identify its format, medium, process, edition and documentation.

Atelier

Works produced personally by Álvaro Ybarra Zavala. Each piece is unique, 01/01, and unrepeatable in its exact combination of format, medium and process. There are no artist's proofs or additional copies with those same characteristics, not even for exhibition. Exhibiting that piece requires asking the collector to lend it and obtaining their consent.

The same photograph may exist in New Collectors, Fine Art or Print Editions with different characteristics. Each Atelier work is signed and comes with a certificate of authenticity.

Fine Art

Exclusively on museum-grade Dibond with a Fine Art conservation lacquer. Four formats per photograph and five copies per format: a maximum of 20 copies on this medium. The edition is not extended with other sizes or additional copies on that medium. Works are signed and come with a certificate of authenticity.

The image may be part of other collections with other media and characteristics.

New Collectors

Traditional black-and-white darkroom prints on Ilford Multigrade Warmtone baryta paper. Exactly 300 commercial copies per photograph, a number that does not increase with framing or variants. Prints are signed and come with a certificate of authenticity.

Additional copies may exist solely for exhibition, identified as such, outside the commercial series and never intended for sale.

Print Editions

Digital UV screen prints on fine art paper. Open edition with no limit on the number of copies, unsigned and without a certificate.

Books

Characteristics and edition are stated for each title. Limited, numbered editions are distinguished from general editions.

Authenticity and personalisation

On New Collectors, Fine Art and Atelier works, the name of the first buyer or acquiring collection is handwritten on the back of the work —on the side opposite the image and, for Fine Art, on the back of the Dibond— together with the author's signature and fingerprint and the corresponding number; for Atelier, 01/01. This is done on the work itself, in addition to the accompanying documentation. All three collections come with a certificate of authenticity.

In limited-edition books, the name of the first buyer or collection, the signature and the fingerprint are added by hand inside the copy, in the space identifying its edition and number. General-edition books and Print Editions do not include this.

Production

Photographic works in the collections are made to order, individually. For books, the production method and availability are specified for each title.
